Delayed flight compensation you can claim

You might be entitled to different levels of compensation depending on the reason for the delay or cancellation of your flight. The table below summarises the financial compensation and/or the care you can claim from the flight company.

Denied boarding / overbooked

What is denied boarding?

This is when you are not allowed to board the flight despite arriving in time for boarding.

How much can you claim?

You can claim financial compensation for delays of more than 3 hours (see the ‘delay’ column).
If you are offered re-routing on an alternative flight, the amount of compensation you are entitled to may be reduced by 50% if your arrival time does not exceed the scheduled arrival time: by 2 hours (for distances below 1,500 km), by 3 hours (for distances between 1,500 km and 3,500 km) or by 4 hours (for distances of more than 3,500 km).

What duty of care does the airline have?

These should be reasonable in relation to the length of delay.

Communications

The airline should provide at least 2 telephone calls, telex or fax messages, or e-mails.

Hotel accommodation

The airline should provide hotel accommodation if you have to stay one or more nights near the airport.

Cancellation

What is cancellation?

This is when a flight which was previously planned and on which at least one place was reserved did not take off.

How much can you claim?

You can claim financial compensation for delays of over 3 hours (see ‘delay’ column).
If you are offered re-routing on an alternative flight, the amount of compensation you are entitled to may be reduced by 50% if your arrival time does not exceed the scheduled arrival time: by 2 hours (for distances below 1,500 km), by 3 hours (for distances between 1,500 km and 3,500 km) or by 4 hours (for distances of more than 3,500 km).
You are only entitled to compensation for a cancelled flight if you were not informed about the cancellation at least 14 days before the scheduled time of departure.

Hotel accommodation

If you are provided with an alternative flight which has an expected time of departure of at least a day after the departure was planned for the cancelled flight then the airline should provide you with hotel accommodation.

Transport

If you are provided with an alternative flight which has an expected time of departure of at least a day after the departure was planned for the cancelled flight then the airline must provide you with transport between the airport and hotel.

Delay

What is delay?

Your flight counts as delayed if it is 2 hours or more delayed.

How much can you claim?

You can claim financial compensation for delays of more than 3 hours, as follows: €250 for distances of up to 1,500 km; €400 for distances between 1,500 km and 3,500 km and €600 for distances of more than 3,500 km.

What duty of care does the airline have?

If the expected time of departure is at least a day after the scheduled departure time then the airline should provide you with hotel accommodation.

How to be able to claim flight compensation later

You need to make sure that the airline cannot claim that you were not at the gate or that you did not wish to fly.

If your flight gets delayed:

  • stay at the gate and listen to the announcements
  • try to collect some ‘proof of delay’ (e.g. take a photo of the departure board with your smartphone)
  • ask for the reason for the delay
  • if you’re bored, you could also tell other passengers about Claim Flights!

If your flight gets cancelled shortly before it was due to take off:

  • try to collect evidence of the cancellation (for example archive emails or printed letters)
  • try to check-in (so that the airline cannot claim that you were not there)
  • take a photo of the information board with your smartphone
  • if possible exchange your business card with other passengers who can act as a witness of the fact you were there.

Depending on the regulation in your home country you have between 3 and 6 years to claim for compensation for previously delayed or cancelled flights. This might depend on the jurisdiction under which you bought your flight ticket. It might be necessary to look into the particular details of your claim to give a clear answer on this.
